Delaware Adoption bills could be voted on in last days of session

HB 154
SYNOPSIS

This bill is intended to strengthen Delaware law pertaining to termination of parental rights and adoptions by giving providing birth parents with proper advice to make this decision and if the child is over 14 days old eliminating any time to reconsider that choice and by shortening the time for adoptions to become final.

To its credit, the bill prohibits any placement of a child for adoption until a pre-placement evaluation of the prospective adoptive parents has been completed by the Division or a licensed adoption agency and it specifies the information that must be in such an evaluation.

The bill also tightens requirements pertaining to consents given by parents to the termination of their parental rights in a child by specifying what must be in their consent, by limiting persons authorized to take consents, and by requiring such persons to explain to the individual who is executing the consent both the contents of the consent and its consequences. These procedures are to assure that any consent is given knowingly and voluntarily. The bill contains procedures for the revocation of a consent and provides for the care and placement of the child if a consent is revoked. However, consent is final at the time they are signed if the child is over 14 days.

The bill specifies the manner in which notice of a termination of parental rights action is to be served on parents and directs the court to attempt to identify and notify any unknown father.

Finally, the bill shortens the time for supervision of an adoptive placement from one year to six months and directs that an adoption will become final in six months. This is straight from the UAA.

HB 120
SYNOPSIS

This Bill [Safe Arms for Babies] is designed to save the lives of babies who might otherwise be abandoned in an unsafe place without medical care. The Bill encourages parents who decide to abandon babies to do so to an employee or volunteer at a hospital emergency department. A parent who complies with this Bill will be immunized from prosecution for the crimes of Abandonment of a Child or endangering the Welfare of a Child. The Department of Health and Social Services shall publicize the provisions of this Act so as to encourage such parents to protect the life of the baby.

You could call this the "Mother Dump" bill! The money they plan to spend advertising this "service" could be better spent providing services to prevent teen pregnancies in the first place or save mother and baby!

CALL NOW

The legislature is expected to pass these bills before they adjourn at the end of June. It could happen in an all night session at the end. If you oppose these bills, NOW is the time to call! Call Senators at home, at work, but call!

Delaware is dangerously close to passing HB 120 to Legalize Infant Abandonment - contact your legislators NOW and tell then to vote against this proposed Bill. It is headed for a final vote in June. All legislator's addresses can be found at the coolest site, - it has everything about all states.

Birthmothers:
We need your help!!

Delaware is trying to pass a law that only gives birthmothers 8 days from the time of delivery to sign away the baby! We're going to legislative hall tomorrow for the first hearing..(We can stop it now)

This is a part of the UAA. I need letters from birthmothers on their opinion of this 8 day time limit...and it will not be challengable! Just as fast as I can get them...It is now 6 months to sign consent papers... now to give her only 8 days to make this very difficult, life altering decision.

Watch out-this may be heading to your state too! We must protect the birthmothers that come after us-and not allow this to happen
